Terms and Conditions of Sale

Expandia Homes LTD — Effective Date: 14 March 2026

1. Acceptance of Terms

By placing an order, paying a deposit, or completing a purchase through expandia.co.nz, the purchaser agrees to be legally bound by these Terms and Conditions. The online checkout process constitutes a binding purchase agreement between the purchaser and Expandia Homes LTD.

2. Pre-Order Sales

Expandable container homes may be sold on a pre-order basis before shipment arrives in New Zealand. Pre-orders reserve a production slot or shipment allocation. Delivery timeframes are estimates only and may vary due to manufacturing schedules, international shipping delays, port congestion, customs processing, weather conditions, or logistics constraints.

3. Deposit and Payment Terms

A deposit may be required to secure a unit. Deposits may be non-refundable once production allocation or shipment reservation has been confirmed unless otherwise required by New Zealand consumer law. Full payment must be completed prior to delivery or release of the unit.

4. Pricing

All prices displayed on expandia.co.nz are in New Zealand Dollars. Unless otherwise stated, prices exclude delivery, crane hire, foundation construction, site preparation, utility connections, engineering reports and building consent costs. Prices may change prior to order confirmation.

5. Delivery

Delivery is arranged through third-party logistics providers. Delivery timelines are estimates only and may be affected by shipping schedules, port delays, weather conditions, transport availability or government restrictions.

6. Risk Transfer

Risk in the product transfers to the purchaser once the product has been delivered to the nominated delivery location or collected by the purchaser or their transport provider.

7. Site Access

The purchaser must ensure the delivery location has adequate truck access, crane access where required, and suitable ground conditions. If delivery cannot occur due to site access issues, additional transport or crane charges may apply.

8. Site Preparation

The purchaser is responsible for ensuring the site is properly prepared before delivery. This includes foundations, ground preparation, drainage, access routes and service connection points.

9. Building Consent

Building consent requirements vary depending on location, intended use, installation method and local council rules. The purchaser is responsible for confirming consent requirements with the relevant local authority.

10. New Zealand Building Code

Expandable container homes are manufactured with consideration for structural integrity, insulation and safety standards relevant to the New Zealand Building Code. Final compliance may depend on foundation design, site conditions, installation method and local authority approval.

11. Utilities and Installation

Expandia Homes LTD does not provide plumbing connections, electrical supply installation, sewage connections, water supply connections or foundation construction unless agreed separately in writing. Qualified licensed trades must be engaged where required.

12. Warranty

Manufacturer warranties may apply to certain components. Warranty coverage may exclude damage caused by incorrect installation, structural modifications, environmental conditions, foundation failure or misuse.

13. Consumer Guarantees

Where goods are purchased for personal use, the Consumer Guarantees Act 1993 applies. Where goods are purchased for business purposes, the parties agree that the Consumer Guarantees Act may be contracted out of to the maximum extent permitted by law.

14. Limitation of Liability

To the maximum extent permitted by New Zealand law, Expandia Homes LTD shall not be liable for indirect, consequential or economic loss. Total liability is limited to the purchase price of the product supplied.

15. Inspection

Customers must inspect the unit upon delivery. Visible transport damage must be reported immediately. Failure to report damage within a reasonable timeframe may constitute acceptance of the product.

16. Order Cancellation

Orders may not be cancelled once manufacturing or shipment allocation has commenced unless agreed by Expandia Homes LTD. Administrative or restocking charges may apply where cancellations are accepted.

17. Import Specification Variation

Due to international manufacturing and shipping conditions, minor variations in product specifications, materials, finishes or fittings may occur. Such variations do not constitute a defect or grounds for cancellation provided the product remains substantially consistent with the advertised product.

18. Engineering and Structural Disclaimer

Site-specific engineering requirements may vary depending on wind zones, seismic zones, snow loads, soil conditions or council requirements. Expandia Homes LTD does not provide site-specific engineering certification unless explicitly agreed in writing.

19. Freight Damage and Transport Liability

Transport providers may be responsible for freight damage during shipping or delivery. Customers must notify any transport damage immediately to enable claims to be lodged with the freight carrier.

20. Force Majeure

Expandia Homes LTD shall not be liable for delays or failure to perform obligations due to events outside reasonable control including natural disasters, port disruptions, shipping delays, labour shortages or government restrictions.

21. Intellectual Property

All content including product images, designs, branding and marketing materials remain the intellectual property of Expandia Homes LTD.

22. Governing Law

These Terms and Conditions are governed by the laws of New Zealand and disputes shall be resolved within the jurisdiction of New Zealand courts.
